You or your representatives using the services provided by WebEstate.co.nz, and or via your registration with WebEstate.co.nz shall indicate your acceptance of the following.

These terms and conditions along with our Privacy Policy form our entire agreement with you the agent.

These terms and conditions supersede any prior agreement or arrangement with you in respect to WebEstate.co.nz.

WebEstate.co.nz reserves the right to edit and update the following terms and conditions.

Availability of WebEstate.co.nz

WebEstate.co.nz will endeavor to ensure that the site and its services are available 24hour a day with out any interruptions. However, WebEstate.co.nz reserves the right to make the site and its services unavailable at any given time or to restrict access to parts or the entire site without notice.

WebEstate.co.nz provides a platform for agents to promote their listings – therefore we are not liable or responsible for the accuracy and creditability of the information accessible on or via WebEstate.co.nz.

Use of WebEstate.co.nz

WebEstate.co.nz is a platform for real estate agents and their representatives to advertise their listings. It is the agents you are responsible for and must abide by the following:

• Ensure the credibility and accuracy of each listing.
• Only use WebEstate.co.nz to list real estate for rent, sale, lease or auction
• Ensure the photos accompanying each listing are a correct representation of the actual listing.
• Ensure contact details provided are correct.
• Use the service provided by WebEstate.co.nz in a responsible manner.
• An agent cannot add a listing for a property that they have not been authorized to sell by the property owner or vendor.
• An agent cannot re-sell the service of WebEstate.co.nz onto others.
• An agent cannot use the services of WebEstate.co.nz for an illegal or unlawful manner.
• An agent cannot add a listing with content which:
  -Is obscene, offensive or abusive
  -Is confidential.
• An agent, when adding a listing will not infringe on any copyright or trademark.

Data Protection

It is your responsibility as the agent to ensure that:

• You provide us with valid contact details
• Update contact details if and when they change.
• Your login details are only available to you and your representatives to use.
• End user information collected from WebEstate.co.nz is only to be used to follow-up on inquires made by end users. (Cannot spam / re-sell email address collected).

Breaching the Terms and Conditions

If an agent is found to breach the outlined terms and conditions, WebEstate.co.nz has the right to:

• Suspend their account
• Remove their listings
• Take what ever action is thought appropriate by the management of WebEstate.co.nz
• Refund for any of the above will not be provided.

Marketing information

WebEstate.co.nz will email the agent with information in relation to marketing and promotional efforts on a regular basis.

WebEstate.co.nz’s Liability.

It is a condition that your use of WebEstate.co.nz is at your own risk. We shall not be liable to you or in breach of these terms and conditions for any delays or failure to perform any obligation, if the delay or failure is due to a cause beyond our reasonable control.

We disclaim all and will not be liable in contract, tort(including, without limitation, negligence) or otherwise arising in connection with WebEstate.co.nz for:

• Indirect or special loss or damage
• Any loss of good will or reputation
• Any economic losses (including revenue, profit, contracts, contacts).

Terminate

If an agent no longer wishes to use the services provided by WebEstate.co.nz, they may terminate by:

• Providing prior written advice of termination
• If notice is received 5 working days of payment – a full refund will be granted.
• Refunds will not be made to terminations after 5 working days of payment.

Data Protection

Data collected will only be used to:

• Provide you the end user with additional information on the particular property that you have inquired about.
• Forward you information on other listings that fit your search criteria (only if you chose this option).
